Do both spouses have to agree to list?
Yes, or a court has to order it. Both signatures go on the listing, the price changes and the closing. We put the rules in the stipulation first so every signature is routine.
Can one agent really represent both of us?
As a neutral listing team with both brokerages disclosed in writing, yes. Each of you may also have your own attorney review everything, and should.
How fast can it sell?
Priced at the market point, most metro Denver homes we list go under contract in the first two to three weeks; the reduction schedule in the stipulation handles the rest without a new fight.
What if my spouse refuses?
A Colorado court can order the sale and appoint the listing agent (C.R.S. 14-10-113). Most refusals end at mediation once the Smart Pricing Report is on the table.
Do we have to be in the same room?
No. Separate showings of the report, separate signings, and the title company disburses to each of you as ordered.
