How we work with counsel

As a transaction broker for the sale, or as a neutral valuation source for a buyout, we send identical materials to both parties and both attorneys at the same time, escalate impasses to counsel instead of resolving them ourselves, and keep a dated log of showings, feedback, offers and any deviation from the stipulation or order. Damon Chavez, a Certified Real Estate Divorce Specialist and Level I and II Collaborative Divorce Professional, runs the file; he is also a Colorado Certified Residential Appraiser, which matters when value is contested.

What we provide

Valuation for the estate

A written Smart Pricing Report with comparables, adjustments, a range and a condition note, delivered to both parties simultaneously. Coordination of an independent appraisal when value is contested, and a written explanation of the difference between a CMA, an appraisal and an automated estimate for the file.

Stipulation and order language

A term sheet covering broker and relationship, list price or price rule, automatic reductions, minimum acceptable offer, repair cap, carrying costs and credits, access and showing rules, and disbursement, including the later escrow refund and HOA reserve items that are usually missed.

Execution under the order

Staging of a half-occupied home, showings around the parenting schedule, no divorce language in any marketing, offers answered with the appraisal, reductions on the schedule.

The record

A dated log of every showing, feedback note, offer, counter and price change, available to either side on request, in a form you can attach to a motion.

Closing and disbursement

Closing statement and disbursement instructions matched to the stipulation or decree; proceeds to the title company or your trust account when the case is not final.

The keeping spouse

Coordination with the lender on refinance and buyout feasibility before a deadline is written into the agreement, so the deadline is real. Mike Oswald at Rate, or any lender the party chooses.

Collaborative and mediated cases

Damon is trained as a collaborative-divorce real estate professional and is listed with Colorado Collaborative Divorce Professionals and South Denver Collaborative Divorce. On a collaborative team he works alongside the attorneys and the financial neutral; in mediation he provides the valuation and the term sheet before the session so the house is decided on numbers in the room.

What we do not do

  • Represent one spouse against the other in a joint sale.
  • Carry messages between the parties.
  • Give legal or tax advice, or predict what a judge will do.
  • Pay or accept anything for a referral, or trade referrals.
  • Use “divorce,” “motivated” or a deadline in any marketing.

For your clients

The free Colorado divorce workshop runs the second Saturday of every month, in person and on Zoom, with a family-law attorney, a financial planner, a lender, a title representative, a counselor and a real estate professional, and the whole program is online at no cost. Attorneys are welcome to present. Join the panel.
