Do I have to move out of the house?
No. Neither spouse has to leave unless a court orders it, and Colorado has no abandonment rule because it is a no-fault state. Moving out does not cost you the equity. It does cost you a second rent while you still owe half the mortgage, and it sets a parenting routine the court may keep. The full answer.
Can I keep the house?
If you can carry it alone and buy out her share. Equity, affordability, desirability, in that order; a lender confirms the affordability piece before any deadline is written. The buyout math.
Will I get 50/50 with my kids?

How much will I pay?
Maintenance: 40 percent of combined income minus her income, times 80 or 75 percent, for a term tied to marriage length, advisory. Child support: both incomes, the statutory schedule, credited for every overnight under the 2026 formula. Worked examples.
Can she take half my retirement? My business?
The part earned during the marriage is marital and divisible, whoever’s name is on it. What you owned before, and inheritances to you, stay separate if you can trace them. The house is often the asset you trade to keep the business or the pension. Business and retirement.
I am 55. Is it too late to start over?
No, and the money works differently after 50: pensions, Social Security, health insurance, a paid-off house. Divorce after 50 for men.
Will the judge side with her?
Colorado judges divide property equitably and decide parenting on the children’s interests. The person who follows the injunction, pays what the orders say, keeps a log and stays civil in writing is the one the court believes. That is a plan you control.
