Gray divorce: sell the house, keep it, or downsize? A Colorado guide for 50-plus
After 50 the house question is different. Here is how to decide it without giving up the retirement you spent 30 years building.

Decide by what you can carry alone for the next 20 years, including a roof and a furnace, and by the tax on the gain. A long-held Denver home can carry $300,000 or more of gain; the $500,000 joint exclusion disappears the day the decree is entered. If carrying the house strains the retirement budget, downsizing now on your own timeline usually beats a forced sale later.
The capital-gains trap
Sequence the sale before the decree, or have the decree give the staying spouse use of the home so the other spouse’s $250,000 survives a later sale. Transfers between spouses are tax-free but carry the original basis. The timing rule.
A paid-off house is still a buyout
No mortgage does not mean no problem. The staying spouse still owes the other their share, funded by a HELOC, other assets, or, at 62 and older, a reverse mortgage with no monthly payment (and real costs). When a reverse mortgage fits.
The downsizing menu
- A single-story home or townhome (metro attached median $370,000 in August 2026).
- A 55+ community; Kenna keeps the complete Colorado list.
- Renting for a year while the decree finishes and the credit heals.
- House-sharing.
The retirement side
Value pre-tax accounts after tax before trading them for the house; get QDROs (and PERA’s order within 90 days) done with the decree; check the 10-year Social Security rule against the decree date. Gray divorce in Colorado.
