Stipulated and ordered sales
Listing terms and disbursement written so the court and the title company can follow them.
Fort Collins is Larimer County’s seat and its largest city, home to Colorado State University and a housing stock that runs from Old Town bungalows to 1990s and 2000s subdivisions on the south and east sides. Divorces are filed at the Justice Center on La Porte Avenue downtown. Rental demand from the university makes “convert it to a rental until a milestone” a more realistic option here than in most metro-Denver suburbs, and we run that math alongside the sale and the buyout.
Selling a house during a divorce in Fort Collins
Once the case is filed and served, neither spouse can list, sell or borrow against the house without the other’s written consent or a court order. So a Fort Collins divorce sale starts with a stipulation both spouses sign (agent, price rules, who pays what until closing, how proceeds are held) or an order from the Larimer County court. Then it is a listing like any other, except that both spouses and both attorneys get the same information at the same time and the divorce never appears in the marketing. The full process, and court-ordered sales.
Keeping the house in Fort Collins
The spouse who stays has to pay the other their share of the equity and qualify for the loan alone. On the Denver-metro detached median of $649,500 with $350,000 owed, that is a $149,750 buyout and, by refinance at today’s rate, a payment that jumps from about $1,476 to about $3,308 a month. A HELOC or an assumption can keep the old rate. Get pre-approved on the real numbers before the decree sets a refinance deadline. The buyout math.

Homes for sale in Fort CollinsThe Larimer County divorce process, briefly
No fault. One spouse must have lived in Colorado 91 days. The petition costs $260, the response $146. Both spouses file a sworn financial statement within 42 days, which asks for the house’s value and the mortgage balance. The earliest decree is 91 days after service. The house is valued as of the decree, divided equitably (fairly, not automatically 50/50), and the decree usually gives the keeping spouse 60 to 90 days to refinance. Divorce in Larimer County.
Questions people in Fort Collins ask
Who gets the house in a Fort Collins divorce?
Nobody automatically. Colorado divides marital property equitably; the house is sold and split, bought out by one spouse, kept for a period for the children, or one spouse assumes the loan. How judges and couples decide.
Can my spouse sell our Fort Collins house without me?
No. Both owners sign a deed, and once the case is filed the automatic injunction bars a sale without consent or a court order.
Do you charge for the valuation?
No. The Smart Pricing Report goes to both spouses free. On a sale we are paid at closing like any agent; no fee if the house does not sell.
Can we use you if only one of us wants to sell?
We can value the house for either spouse and explain the options to both. A listing needs both owners’ signatures or a court order; the attorneys handle that part. If one spouse refuses.
