Choosing the right professional

What a divorce real estate specialist actually does

Any licensed agent can list a house. A divorce real estate specialist handles the part that a normal sale never has: two owners who may not agree, two attorneys, a court deadline, a stipulation that controls the listing, and proceeds that cannot be touched until the decree says how to split them. Here is what the job is, what the designations mean, and the questions to ask before you hire anyone.

Valuation

One written number, to both spouses

A market analysis both attorneys can rely on, delivered to both sides at the same time, with a net sheet at each price.

Terms

Listing terms written for the stipulation

Price, reductions, showings, repairs, who pays the mortgage, and disbursement, agreed before the sign goes up.

Neutral

The same facts to both of you

A log of every showing and offer to both spouses and both attorneys. Nothing about the divorce in the marketing.

Closing

Proceeds split as the decree says

Separate signings if you want them, and the title company disburses exactly as ordered.

The designations, honestly

Several credentials exist. Damon L. Chavez holds the Certified Real Estate Divorce Specialist designation and is a Certified Residential Appraiser, which is why the valuation on every Kenna divorce file is his to review. Other agents in Colorado hold the Certified Divorce Real Estate Expert designation from a different program. No designation replaces the questions below; the process is what protects you.

Eight questions to ask before you hire a divorce realtor

Will both spouses get the same valuation at the same time?

If the answer is anything but yes, in writing, keep looking.

Will you read the decree or stipulation before listing?

The listing terms have to match the court paperwork, not the other way round.

How do you communicate with two attorneys?

Every showing, every offer, every price conversation, copied to both. Ask to see a sample log.

What happens if my spouse refuses to sign?

A specialist knows the path: the stipulation, the motion, the court-ordered sale, the authorized signature.

Where do the proceeds sit?

At the title company, until the decree or a signed agreement says how to split them. Never in one spouse's account.

Who is behind you?

One agent gets sick or goes on vacation. A group with a designated specialist and fourteen licensed professionals does not miss a showing window.

How do you market a half-occupied home?

Photography, flyover video, floor plans and Zillow Premier placement that never mention the divorce.

Do you pressure people to list?

You should be able to get the numbers first. We give you a written value and the options with no obligation.
