Day 1: read and date it. Days 1 to 3: your own account, freeze your credit, document joint balances, do not drain anything. Days 2 to 7: gather three years of records and the house documents. Days 3 to 10: one consultation with a family-law attorney and a visit to the self-help center. Before day 21: file your Response (JDF 1015, $146). Any time: a written valuation and a pre-approval so the house decision is made on numbers.
What the injunction now requires of both of you
No selling, transferring, hiding or borrowing against marital property; no cancelling insurance; no taking the kids out of state; no disturbing the peace. It protects you as much as it binds you.
Three things people get wrong in week one
- Moving out without advice. Nobody has to leave, and leaving affects who stays during the case and means paying for two homes.
- Stopping the mortgage to make a point. It is your credit too.
- Ignoring the 21 days. A default can grant what the petition asks for.
