Can I use my divorce settlement as a down payment in Colorado?

Yes, you can use a divorce settlement as a down payment in Colorado when the money has a paper trail. This post shows what lenders verify, how QDRO and gift money work, and what $500,000 costs at each down payment.

The short answer

Yes. You can use a divorce settlement as a down payment in Colorado, and lenders accept it when the money has a paper trail: the decree that awards it, plus the wire, bank statement or closing statement that shows it arriving. Equity buyout cash and home sale proceeds count as documented funds. Retirement money moved by QDRO and gift funds work too, and lenders want cash left in the bank after closing. A $500,000 Colorado home takes $17,500 down on an FHA loan.

Can I use my divorce settlement as a down payment in Colorado?

Yes. A lender treats settlement cash like any other asset once it can trace where the money came from. Three kinds of settlement money show up most: an equity payment from a spouse who keeps the home, your share of the proceeds when the home sells, and retirement assets divided in the decree.

Colorado divides marital property by equitable distribution under C.R.S. 14-10-113, so your decree sets your share, not a fixed 50-50 rule. Read home equity and spousal buyouts to see how the payment is set, and run the buyout calculator example with your own numbers.

How does a lender verify settlement money?

The lender wants three documents, and each one closes a question.

  • The decree: shows the award, the amount and the due date.
  • The transfer: a bank statement showing the deposit, the wire confirmation from your ex's bank, or the settlement statement from the marital home closing.
  • The account: 2 months of statements in your name showing the balance after the deposit.

If your ex refinances and pays you at that closing, the closing disclosure for the refinance shows your payout. If the decree pays you in installments, only the installments that have cleared count toward your down payment. The house section of this site explains each way the home settles, and mortgage qualification after divorce lists the paperwork a lender asks for.

Does settlement cash have to sit in my account for 60 days?

No, when the source is documented. Lenders ask for 2 months of bank statements and question any deposit that is not payroll. That is seasoning: money that has sat for 60 days needs no explanation. Money with a documented source, such as a decree payment or a closing statement, does not need to sit, because the paper trail replaces the wait.

The deposit that stalls a file is the one with no source, like a large transfer from a friend with no gift letter. Your lender confirms the rule for your loan. Keep the settlement in one account and move it as little as possible, because every transfer is one more line to explain.

Can I use retirement money moved by QDRO?

Yes, and it costs more than cash. A qualified domestic relations order, a QDRO, divides a workplace plan such as a 401(k). Money paid to you under a QDRO is taxable income to you. The 10 percent early-withdrawal penalty does not apply to a QDRO payment from a workplace plan, but it applies if you roll the money into an IRA and take it out later. Confirm your case with a CPA before you pull a dollar.

Taking $30,000 out to buy a home costs you the tax on $30,000 and the growth that money would have earned. Most buyers use cash first and retirement money last. See retirement and pensions in divorce for how the split works, and gray divorce and retirement income if you are past 50.

Can a relative gift part of the down payment?

Yes. FHA and conventional loans accept gift funds from a relative with a signed gift letter that says the money is a gift with no repayment. The lender wants the donor's transfer documented and the deposit in your account. On a conventional loan with 3 percent down for a first-time buyer, gift money can cover the whole down payment.

A loan from a parent is different. A repayment obligation counts as debt in your ratio. Colorado also runs down payment assistance through CHFA and metroDPA, and your lender tells you which programs fit your income and the home's location. Start with the first-time buyer guide and the financing page.

How much cash does a lender want left after closing?

Reserves are the months of full housing payments left in the bank after you close. Plan on at least 2 months, and plan on more if your loan is larger or your credit is thinner. Your lender sets the number on your file.

Reserves are why putting every dollar of the settlement into the down payment backfires. A hail deductible or a water heater does not wait for payday. See living on one income after divorce for the monthly math, divorce with no savings if the settlement is thin, and what closing costs are so you budget them before you pick a percentage.

What does $500,000 look like at each down payment?

Denver metro median prices sit in the $500,000s to $600,000s, so a $500,000 home is a fair example. The table shows five ways to buy it. FHA is 3.5 percent down, conventional is 3 percent down for first-time buyers, and VA is zero down with restored entitlement. Read FHA and VA home buying to see who qualifies for which.

OptionDown paymentLoan amountPrincipal and interest a month
VA, zero down$0$500,000$3,160
Conventional, 3 percent$15,000$485,000$3,065
FHA, 3.5 percent$17,500$482,500$3,049
Conventional, 10 percent$50,000$450,000$2,844
Conventional, 20 percent$100,000$400,000$2,528

The payments use a 6.5 percent example rate, so every $100,000 borrowed costs about $632 a month in principal and interest. They exclude taxes, insurance, HOA dues, mortgage insurance and financed fees. Your lender runs the real numbers in a mortgage pre-approval.

Settlement or sale cashRetirement transferSavings or gift$0$50,000$100,000$17,500A: FHA, 3.5%$50,000B: 10% down$100,000C: 20% down
Three examples on a $500,000 home. A: $12,500 of settlement cash and $5,000 of savings. B: $30,000 of settlement cash, $12,000 from a QDRO and $8,000 of gift money. C: $70,000 of sale proceeds, $20,000 from a QDRO and $10,000 of savings. Amounts are illustrations, not averages.

Should the whole settlement go into the down payment?

No. Split the settlement into four buckets before you pick a down payment percentage.

  • Down payment: the percentage you choose, from 0 percent on VA to 20 percent conventional.
  • Closing costs: lender fees, title, prepaid taxes and insurance, paid at the closing table.
  • Reserves: at least 2 months of full payments, kept in the bank.
  • Move-in costs: beds, a washer and dryer, locks and the first repairs.

Then check the payment against one income. The one-income Denver buying page shows the math, and mortgage after divorce covers the loan side. If you are still deciding whether to keep or sell the marital home, compare keeping the house with selling the house; the taxes on a sale are on sell before or after divorce: taxes.

Quick answers

Do I owe tax on equity my ex pays me in the divorce?

A property transfer between spouses under a decree is not taxed as a sale. Retirement withdrawals and a home sale are different, so confirm your case with a CPA.

Will the lender ask where my ex got the money?

No. The lender wants the decree that awards you the money and the deposit in your account. Where your ex found it is between your ex and the court.

What if the decree pays me in installments?

Only the installments that have cleared count as down payment cash. Future installments do not count toward your down payment or your reserves.

Is money from my parents a gift or a loan?

It is a gift only with a signed gift letter that says no repayment. Any repayment obligation is a loan, and the lender counts it as debt.

How big should my reserves be?

At least 2 months of full housing payments in the bank after closing. Your lender sets the exact number, and a larger loan or thinner credit raises it.

Can I use metroDPA or CHFA with settlement money?

Yes, when you meet the program's income and price limits. Your lender confirms which program fits the home and your file, and settlement cash covers the rest.

Can the group help me plan the down payment?

Yes. We run a payment check with the lender and value the marital home in writing so you know your proceeds. Call or text 303-955-4220.
